Wholesale alcohol rules in Michigan

Whether a producer may sell direct to a retailer here, by beverage class. Each row says how well sourced it is: whether we read the statute ourselves, or are still working from our own notes or a secondary summary.

This is the producer-to-retailer lane. Sales through a licensed wholesaler are the ordinary route and are not what these rows describe. Nothing here is legal advice — it is a record of what we read, published so you can check it.

Michigan is a control state for spirits — the state is the wholesaler for that class, so there is no private distributor lane in it.

Beer

Open, but conditional

Condition: A micro brewer may sell and deliver to a retailer only if that retailer is NOT within an exclusive sales territory for the brewer’s brands, and delivery must be by the brewer’s own employee in the brewer’s own vehicle.

Open to in-state and out-of-state producers.

MCL 436.1203a, with MCL 436.1109 (definition) — verified 2026-10-25.

Wine

Open, but conditional

Condition: An IN-STATE wine maker needs nothing further. An OUT-OF-STATE maker must hold an OUTSTATE SELF-DISTRIBUTOR licence (MCL 436.1109(10)), which is open only to the substantial equivalent of a SMALL wine maker — not more than 50,000 gal a year — and whether a given winery holds one is not a fact an order carries.

Open to in-state and out-of-state producers.

MCL 436.1113(10) (wine maker licence, as amended by 2021 PA 19) — verified 2026-10-25.

Spirits

Open, but conditional

Condition: The spirits must NOT be listed in the Michigan price book, and delivery must be by the distiller’s own employee in a vehicle the distiller owns. Neither is a fact an order carries.

  • No more than 3,000 gal/yr may move through this lane

Open to in-state and out-of-state producers.

MCL 436.1203(20), with 436.1203(25)(o) (definition) — verified 2026-10-25.

RTD / canned cocktails

Open, but conditional

Condition: The retailer must NOT sit in a sales territory where the manufacturer has granted a wholesaler exclusive rights under MCL 436.1307 for any of its brands, and delivery must be by the manufacturer's OWN EMPLOYEE — "not an agent" — in a vehicle the manufacturer OWNS. Neither is a fact an order carries.

  • No more than 31,000 gal/yr may move through this lane

Open to in-state and out-of-state producers.

MCL 436.1203b (mixed spirit drink manufacturer) — verified 2026-10-25.

A class not listed above is one nobody has read yet — not even a secondary summary. It is not a finding that Michigan forbids it. Every row above links the statute it rests on, so you can check the reading for yourself.
